This site is owned by Vintage Cellars (hereafter THE MERCHANT) and registered in England, Registration No. 07198819 , with registered address at 33 Churton Street, London SW1V 2LT. (hereafter THE MERCHANT ADDRESS), and email address at sales@vintagecellars.co.uk

Any purchase of goods from the site www.vintagecellars.co.uk (hereafter THE MERCHANT SITE) requires the customer to consult and accept these terms and conditions. The click validating the order implies full acceptance of these terms and represents the customer's "digital signature".


Purpose


These terms and conditions are intended to define the rights and obligations of the parties in the sale of goods proposed online by THE MERCHANT for the customer.

Order Confirmation

By placing an order on the Vintage Cellars site you are confirming that you are 18 or older, as it is illegal to sell alcohol to anyone under 18 years of age.

When you give Vintage Cellars your credit or debit card details you are confirming that you are the cardholder or that you have permission from the cardholder to use the card for the purpose of ordering wine.

Placing an order on our website does not constitute a contract. Our acceptance of an order takes place when we dispatch the order.

In the event that a product is unavailable when you place your order, we shall contact you to arrange replacement, or another acceptable arrangement for the completion of your order.

We reserve the right not to accept any order in which case your payment will be refunded. We will contact you by e-mail to explain why the order has been canceled.

All goods are offered subject to availability.

We cannot guarantee vintages.



Proof of Transaction

The records stored in THE MERCHANT's computer systems under reasonable safety conditions are considered proof of communications, orders and payments made between the parties.
Purchase orders and invoices are stored on a reliable and durable system and can be produced as evidence.

Product Information

Every effort has been made to ensure the accuracy of the products offered by us on our web site, which are offered subject to remaining unsold. The products offered by us are displayed in 'real time' This is to say that any product maybe withdrawn from offer without notice.

Product photos, descriptions and prices are non contractual.



Validity Period of Offer and Prices

Our offers and prices are valid for the day the site is consulted and are subject to change without notice.

Delivery Terms

The wines are delivered to the address which you specified on the purchase order and only to geographic areas that we service within the UK

Delivery takes place when the products are left at your delivery address or with someone else in accordance with your instructions.

If your order is damaged or goes missing between dispatch and delivery you must notify us as soon as possible and no later than within 3 days of delivery , either in writing or by e-mail and we will send out a replacement order. Should we not be able to send a replacement within 7 days we will give you a full refund. Claims made outside the three day period will not be entertained.

In the event of damaged goods please provide photos.

We shall not be held responsible for any delay in the delivery of your order due to the carrier including the loss of the goods, bad weather or strikes.

If for some reason an incorrect wine is dispatched please advise so that we can arrange its collection and the delivery of the correct wine.

Our standard delivery service is 2 working days to most UK addresses. Please check delivery postcodes for exclusions at the bottom of the page.
1 bottle will be dispatched Royal Mail second class at £3.

2 bottles will be dispatched Royal Mail second class at £ 4.50

3-12 bottles will be dispatched by CYC and will be charged at £12.60
Over 12 bottles, the extra case is charged at £5.

We deliver only in mainland UK with the exception of the Isle of Wight- delivery charge is £ 20.00.


Warranty

All our wines are covered by our money back guarantee and will provide a full refund or replacement for any wines that are faulty. This does not affect your statutory rights.

We may require faulty bottles to be returned to us. We will arrange this as necessary at your convenience.


Right to Withdrawal

In accordance with the Distance Selling Regulations 2000 you have the right to cancel your order at any time until seven working days after delivery. Should you decide to cancel, all charges to you will be refunded as soon as the goods are returned to us at your expense in merchantable condition. All returns can be indicated before with the Vintage Cellars customer services.

If the right to withdraw is exercised Vintage Cellars will make every effort to refund the customer within 30 days.


Right of Use

The use of any trademarks, logos or brands present on the site is strictly forbidden.

Force Majeure

Neither party will be deemed to be in breach of any of its obligations under the agreement as a result of any delay in performing or any failure to perform any such obligations by reason of any cause or event beyond the parties' control. A force majeure event includes, but is not limited to, any unforeseeable, inevitable, or unstoppable act, event, non-happening, omission or accident beyond the control of either party, despite all reasonable efforts made to the contrary. In addition to events usually recognized by the British courts, a force majeure event includes in particular (without limitation) the following: Strike, lock-out, earthquake, fire, storm, flood, lightning, explosion, impossibility of the use of public or private telecommunications networks.
In such circumstances, the party delayed or unable to perform ("Delayed Party") shall notify the other party ("Affected Party") within ten (10) business days following the date such events become known.
Unless prevented due to force majeure, both parties will meet within three months to examine the impact of the event and agree to the conditions under which the contract shall be continued. If the force majeure lasts longer than one (1) month, this agreement may be terminated by the injured party.

Partial Invalidity

These terms and conditions remain valid and in force, even if one or more clauses are invalid or declared so under any law, regulation or following the final decision of a competent court.

Non-Waiver

No failure of either party to exercise any power given to it in these terms and conditions or to insist upon strict compliance by the other party with its obligations hereunder shall constitute a waiver of either party's right to demand exact compliance with the terms hereof.

Data Protection

Vintage Cellars do not disclose buyers information to third parties other than when order details are processed as part of order fulfilment. This data will be treated in accordance with the Data Protection principles in the Data Protection Act 1998.

Applicable Law and Competent Jurisdiction

In form and content, these Terms and Conditions shall be governed by and construed in accordance with English law. All orders placed on THE MERCHANT SITE strictly imply the acceptance of THE MERCHANT's terms and conditions.

In case of dispute or claim, the customer agrees to seek an amicable solution with THE MERCHANT before proceeding with any legal action. In the event where such a solution cannot be found, any disputes concerning the sale (price, Terms and Conditions, products, etc.) will be subject to the exclusive jurisdiction of the English courts.
